Wyoming Labor & Employment Laws – What You Need to Know
Wyoming law sets clear standards for employers, workers, and service providers. All hiring and service posts must comply with the following:- Minimum Wage: Wyoming has a state minimum wage of $5.15 per hour, but this rate is lower than the federal standard. Any employer subject to the Fair Labor Standards Act (FLSA) must pay the federal minimum wage of $7.25 per hour. The minimum cash wage for tipped employees is $2.13 per hour, with employers required to make up the difference if tips combined with the cash wage do not reach the $7.25 threshold. Agricultural employers are not covered by the FLSA.
- Overtime Pay: Wyoming follows the federal FLSA standard for overtime. Non-exempt employees are entitled to 1.5x the regular rate after 40 hours in a workweek. Public works projects specifically require time-and-a-half pay for any work over 40 hours in a week. The federal salary exemption threshold is currently $1,128 per week ($58,656/year).
- Final Paychecks: If an employee leaves a job, the employer must provide the final paycheck by the next regularly scheduled payday.
- Worker Classification:Wyoming has no specific independent contractor misclassification law. Past efforts to enact such a law have failed. For workers' compensation and unemployment purposes, an "independent contractor" is defined as an individual who:
- Is free from control or direction over the details of the performance of services by contract and by fact;
- Represents their services to the public as a self-employed individual or independent contractor; and
- Can substitute another person to perform their services.
- Licensing & Registration Requirements:Wyoming's contractor licensing landscape is unique:
- No state-level general contractor license – General contractor firms are not licensed at the state level.
- No state-level mechanical/HVAC or plumbing contractor license – These trades are not licensed at the state level, though individual and local requirements may apply.
- State-required electrical contractor licenses – Administered by the Department of Fire Prevention & Electrical Safety. Electrical contractors, low voltage electrical contractors, and limited electrical contractors must file an annual license application and employ a licensed technician of record (master electrician, low voltage technician, or limited technician). License fees range from $200–$400 and renew annually by July 1.
- Local licensing requirements – Many cities and counties require contractor licenses. For example, Cheyenne requires multiple contractor classifications (Class A General, Class B Building, Class C/D Subcontractor, HVAC, Plumbing, etc.) with fees ranging from $75–$600 annually.
- Under Wyoming Statute § 16-6-1101, accepting jurisdictions must recognize licenses issued by other Wyoming jurisdictions if the contractor's license is active and in good standing. The contractor must provide proof of successful completion of the appropriate ICC examination or equivalent.
- Workplace Rights: Wyoming law prohibits discrimination and unfair labor practices. Workers have the right to file complaints with the Wyoming Department of Workforce Services Labor Standards Division, which enforces labor laws and resolves workplace issues.
- Notice Requirements: Employers must display required labor law postings in the workplace, including information about minimum wage, workers' compensation, unemployment compensation, and anti-discrimination protections. Free labor law posters are available through the DWS.
