Vermont Labor & Employment Laws – What You Need to Know
Vermont law sets clear standards for employers, workers, and service providers. All hiring and service posts must comply with the following:- Minimum Wage: Vermont's standard minimum wage is $14.42 per hour (effective January 1, 2026). The minimum cash wage for tipped employees is $7.21 per hour (50% of the standard minimum wage) for employees who make at least $120 per month in tips. If an employee's tips combined with the base rate do not equal at least the standard minimum wage, the employer must make up the difference.
- Overtime Pay: Vermont follows the federal Fair Labor Standards Act (FLSA) standard, requiring 1.5x the regular rate after 40 hours in a workweek.
- Worker Classification (The ABC Test): Vermont uses the strict **ABC Test** to determine if a worker is an independent contractor. All three criteria (freedom from control, work outside the usual course of business, and an independently established business) must be met; otherwise, the worker is legally presumed to be an employee. Willful misclassification to avoid paying unemployment taxes, workers' compensation, or overtime carries severe penalties.
- Licensing & Registration Requirements: Vermont does not issue state-level company licenses for general commercial contractors, but individual tradespeople (like plumbers and electricians) must hold specific state licenses. Crucially, under the Vermont Residential Contractor Registration Act, **contractors who perform residential construction where the estimated value is $10,000 or more (inclusive of labor and materials) must register with the Office of Professional Regulation (OPR).** Registered contractors are also required to maintain liability insurance and use a written contract.
- Workplace Rights & Breaks: Vermont employers must provide employees with a "reasonable opportunity" to eat a meal and use restroom facilities. A meal break may be unpaid if it is at least 30 minutes long and the employee is completely relieved of all duties. Nursing employees are entitled to reasonable break time and a private space for up to three years after childbirth to express milk.
