🔍 Utah Labor & Employment Laws – What You Need to Know

Utah law sets clear standards for employers, workers, and service providers. All hiring and service posts must comply with the following:

  • Minimum Wage & Overtime: Utah adopts the federal minimum wage of $7.25 per hour. The state has no separate minimum wage law, and local municipalities are prohibited from establishing their own higher rates. The minimum cash wage for tipped employees is $2.13 per hour. Overtime strictly follows the federal Fair Labor Standards Act (FLSA), requiring 1.5x the regular rate after 40 hours in a workweek.
  • E-Verify Requirements: Under the Utah Private Employer Verification Act, private employers with 150 or more employees must use the federal E-Verify system to confirm the work authorization of all new hires. Additionally, any contractor (regardless of size) entering into a contract with a Utah public or state agency must use a Status Verification System.
  • Worker Classification: Utah enforces strict worker classification rules to prevent misclassification of employees as independent contractors (1099s). The Utah Labor Commission and the Division of Antidiscrimination and Labor actively investigate misclassification designed to bypass unemployment taxes, workers' compensation, and benefits.
  • Workers' Compensation: Utah law requires every employer who regularly employs one or more workers (including part-time or seasonal) to carry workers' compensation insurance. Contractors working for political subdivisions or state agencies must provide proof of coverage.
  • Licensing Requirements & The Handyman Exemption: The Division of Professional Licensing (DOPL) strictly regulates construction and trades. However, Utah offers a Handyman Exemptionfor minor repairs:
    • Jobs under $1,000: No license or registration required.
    • Jobs between $1,000 and $3,000 (total labor and materials): You must file a Handyman Exemption registration with the DOPL and carry liability insurance.
    • Jobs over $3,000: Require a full Utah Contractor License.
    • Note: Plumbing, electrical, and HVAC work always require a state license, regardless of the job size. (Also note: The HVAC contractor license is transitioning to the new H100 HVAC Qualifier License format effective January 2027).
  • Workplace Rights & Breaks: Utah law does not mandate meal or rest breaks for adult employees. However, minors under 18 are entitled to a 30-minute meal break within the first 5 hours of a shift and a paid 10-minute rest break for every 4 hours worked. Utah strictly prohibits discrimination and retaliation in the workplace.
