Tennessee Labor & Employment Laws – What You Need to Know
Tennessee law sets clear standards for employers, workers, and service providers. All hiring and service posts must comply with the following:- Minimum Wage: Tennessee does not have a state minimum wage law and instead defers to the federal rate of $7.25 per hour under the Fair Labor Standards Act (FLSA). The minimum cash wage for tipped employees is $2.13 per hour, with employers required to make up the difference if tips combined with the cash wage do not equal the full minimum wage of $7.25 per hour.
- Overtime Pay: Tennessee follows federal FLSA standards exclusively, with no state-specific overtime laws. Non-exempt employees are entitled to 1.5x the regular rate after 40 hours in a workweek. The federal salary threshold for exempt employees remains $684 per week ($35,568 annually) after a 2024 federal court ruling blocked planned increases.
- Mandatory E-Verify: Under Tennessee Public Chapter 772, effective July 1, 2026, all state and local government employers are required to use the federal E-Verify system to confirm the work authorization status of any new hires. Contractors bidding on or performing work for local governments or local education agencies must be aware of these strict compliance measures.
- Payment of Wages: Tennessee employers must pay all wages due to employees on a regular payday designated in advance. The Tennessee Department of Labor and Workforce Development enforces wage payment laws through its Workplace Regulations & Compliance Division.
- Worker Classification: Tennessee strictly enforces worker classification standards. For services performed on or after January 1, 2020, the state uses the 20-factor test from IRS Revenue Ruling 87-41 to determine whether a worker is an employee or independent contractor. Factors include instructions, training, integration, services rendered personally, set hours, full-time requirements, and the right to discharge, among others. Misclassifying an employee as an independent contractor (1099) to avoid paying unemployment taxes, workers' compensation, or benefits carries severe penalties.
- Licensing & Registration Requirements: Many professions require a valid state license. Crucially, under Tennessee law, a contractor's license is required before bidding or negotiating a price for projects costing $25,000 or more as a prime (general) contractor. Subcontractors performing electrical, mechanical, plumbing, HVAC, or roofing work must also be licensed when their portion of the project is $25,000 or more; masonry subcontractors must be licensed when the project is $100,000 or more. Contractors must pass the Tennessee "Business and Law" exam and, depending on the classification, a trade exam. Out-of-state contractors cannot operate using another state's license; reciprocal agreements only provide a trade exam waiver. Anyone posting professional services must verify they hold the appropriate state licenses, local permits, or Board for Licensing Contractors registrations.
- Workplace Rights: Tennessee law prohibits discrimination and retaliation in the workplace. Workers have the right to file complaints with the Tennessee Department of Labor and Workforce Development or the Equal Employment Opportunity Commission (EEOC).
- Notice Requirements: Employers must display required labor law postings in the workplace, including information about workers' compensation, minimum wage, unemployment compensation, and anti-discrimination protections.
