South Dakota Labor & Employment Laws – What You Need to Know
South Dakota law sets clear standards for employers, workers, and service providers. All hiring and service posts must comply with the following:- Minimum Wage: South Dakota's standard minimum wage is $11.85 per hour effective January 1, 2026. The minimum wage is adjusted annually based on cost of living increases measured by the Consumer Price Index. The minimum wage for tipped employees in South Dakota is $5.925 per hour (half the standard minimum wage). If an employee's tips combined with the base rate do not equal at least the standard minimum wage, the employer must make up the difference.
- Overtime Pay: South Dakota does not have a state overtime law applicable to private employers. However, South Dakota employers must still comply with the federal Fair Labor Standards Act (FLSA), which requires non-exempt employees receive 1.5x the regular rate after 40 hours in a workweek.
- Payment of Wages: South Dakota employers must pay all wages due to employees on a regular payday. The state's wage payment laws cover employee wage claims.
