Rhode Island Labor & Employment Laws – What You Need to Know
Rhode Island law sets clear standards for employers, workers, and service providers. All hiring and service posts must comply with the following:- Minimum Wage: As of January 1, 2026, Rhode Island's standard minimum wage is $15.00 per hour. The minimum wage for tipped employees is $3.89 per hour (cash wage). If an employee's tips combined with the $3.89 base rate do not equal at least $15.00 per hour, the employer must make up the difference.
- Overtime & Premium Pay: Employers must pay 1.5x the regular rate after 40 hours in a workweek. Additionally, Rhode Island strictly requires retail and certain other employers to pay premium pay (1.5x) for work performed on Sundays and designated state holidays, regardless of whether the employee has hit 40 hours for the week.
- Sick & Safe Leave: Under the Healthy and Safe Families and Workplaces Act, employers with 18 or more employees must provide paid sick and safe leave. Employers with fewer than 18 employees must provide unpaid, job-protected leave.
- TDI & TCI: Rhode Island mandates employee-funded Temporary Disability Insurance (TDI) and Temporary Caregiver Insurance (TCI) programs, which provide wage replacement for disability or family leave. Employers are required to facilitate these payroll deductions and comply with job protection rules.
- Worker Classification: Rhode Island strictly enforces worker classification. Misclassifying an employee as an independent contractor (1099) to avoid paying workers' compensation, unemployment taxes, or benefits carries severe civil and criminal penalties.
- Licensing & Registration Requirements: Many professions require a valid state license. Anyone performing commercial or residential construction, roofing, or remodeling must be registered with the Contractors' Registration and Licensing Board (CRLB). Anyone posting professional services must verify they hold the appropriate state licenses, local permits, or CRLB registrations.
- Workplace Rights: Rhode Island law prohibits discrimination and retaliation in the workplace. Workers have the right to file complaints with the Rhode Island Department of Labor & Training (DLT), the Rhode Island Commission for Human Rights (RICHR), or the Equal Employment Opportunity Commission (EEOC).
- Notice Requirements: Employers must display required labor law postings in the workplace, including information about workers' compensation, minimum wage, unemployment compensation, and anti-discrimination protections.
