🔍 Pennsylvania Labor & Employment Laws – What You Need to Know

Pennsylvania law sets clear standards for employers, workers, and service providers. All hiring and service posts must comply with the following:

  • Minimum Wage: Pennsylvania's standard minimum wage matches the federal rate of $7.25 per hour. The minimum wage for tipped employees in Pennsylvania is $2.83 per hour.   • Construction Workplace Misclassification Act (CWMA): Pennsylvania strictly enforces worker classification in the commercial and residential construction industries. Misclassifying an employee as an independent contractor (1099) to avoid paying workers' compensation, unemployment taxes, or benefits carries severe civil and criminal penalties.
  • Licensing & Registration Requirements: Many professions require a valid state license. Crucially, under the Home Improvement Consumer Protection Act (HICPA), any contractor performing more than $5,000 of home improvements per year must register with the Pennsylvania Attorney General's Office.
