🔍 Oregon Labor & Employment Laws – What You Need to Know

Oregon law sets strict standards for employers, workers, and service providers. All hiring and service posts must comply with the following:

  • Minimum Wage (Tiered System): Oregon's minimum wage is determined by a three-tier system based on geographic location (Standard, Portland Metro, and Non-Urban counties). Rates adjust annually every July 1st based on inflation. Employers must verify the current rate for their specific county via the BOLI website.
  • No Tip Credit: Oregon does not allow a tip credit. Employers must pay tipped employees the full, applicable state minimum wage for all hours worked, regardless of tips received.
  • Overtime Pay: Oregon requires premium pay at 1.5x the regular rate after 40 hours in a workweek for non-exempt employees. Certain manufacturing and cannery workers have additional daily overtime protections.
  • Sick Time: Employers with 10 or more employees (or 6 or more employees if they have a location in Portland) must provide paid sick time. Employers with fewer employees must provide unpaid, protected sick time. Employees accrue 1 hour of sick time for every 30 hours worked, up to 40 hours per year.
  • Paid Leave Oregon: Oregon requires employers and employees to contribute to a state insurance fund that provides workers with up to 12 weeks of paid time off for family, medical, or safe leave.
  • Predictive Scheduling (Fair Work Week): Large employers in the retail, hospitality, or food services industries (with 500+ employees globally) must provide employees with written work schedules at least 14 days in advance. Changes made within the 14-day window may require the employer to pay penalty wages.
  • Workplace Rights: Oregon law strictly prohibits discrimination, harassment, and retaliation in the workplace. Workers have the right to file complaints with the Oregon Bureau of Labor and Industries (BOLI) or the Equal Employment Opportunity Commission (EEOC).
  • Licensing Requirements: Many professions – including contractors (via the CCB), electricians, plumbers, cosmetologists, real estate agents, and others – require a valid license issued by the appropriate Oregon licensing board or commission. Anyone posting professional services must verify they hold the appropriate license.
  • Notice Requirements: Employers must display required labor law postings in the workplace, including information about the tiered minimum wage, sick time, Paid Leave Oregon, workers' compensation, and anti-discrimination protections.
