North Dakota Labor & Employment Laws – What You Need to Know
North Dakota law sets clear standards for employers, workers, and service providers. All hiring and service posts must comply with the following:- Minimum Wage: North Dakota's minimum wage is $7.25 per hour, which matches the federal minimum wage. Employers must pay the higher of state or federal rates. North Dakota is a right-to-work state.
- Tipped Employees: Employers may pay tipped employees a cash wage of $4.86 per hour, with a tip credit of $2.39 per hour, provided tips bring total compensation to at least $7.25 per hour.
- Payment of Wages: Employees who voluntarily resign or are involuntarily terminated must receive their final paycheck by the next regular payday.
- Meal and Rest Breaks: Under state law, employers must provide a minimum 30-minute break for each shift exceeding five hours when two or more employees are on duty.
- Overtime Pay: North Dakota follows federal Fair Labor Standards Act (FLSA) requirements for overtime pay, requiring premium pay (one and one-half times the regular rate) after 40 hours in a workweek for most non-exempt employees. Certain employees may be exempt based on their duties and salary level.
- Workers' Compensation (Monopolistic State): North Dakota is a monopolistic state for workers' compensation insurance. Employers cannot purchase workers' comp coverage from private insurers; they are strictly required to secure coverage directly through the North Dakota Workforce Safety & Insurance (WSI) state fund.
- Worker Classification: North Dakota has a presumption of employment. The North Dakota Department of Labor and Human Rights can verify the status of independent contractor relationships. Workforce Safety & Insurance (WSI) uses a 20-factor "common law" test to determine whether a worker is a contractor or employee for workers' compensation purposes, with emphasis placed on integration, continuing relationship, significant investment, right to dismiss, and realization of profit/loss. General contractors bear legal responsibility to ensure independent contractors and subcontractors are adequately insured and may be liable for unpaid premium and penalties for uninsured contractors.
- E-Verify and Immigration Verification: North Dakota places no additional employment verification procedures on employers beyond federal I-9 compliance. There is no state requirement to use E-Verify under North Dakota law.
- Non-Compete Agreements: North Dakota has an absolute ban on employment-based non-compete agreements. Non-competes are void and legally unenforceable unless they are connected to the sale or dissolution of a business.
- Workplace Rights: North Dakota law prohibits discrimination and retaliation in the workplace. Workers have the right to file complaints with the North Dakota Department of Labor and Human Rights or the Equal Employment Opportunity Commission (EEOC).
- Child Labor Laws:North Dakota has strict child labor regulations under N.D.C.C. § 34-07-01 to 34-07-21:
- Under 14: Generally prohibited from employment, with limited exceptions for agricultural work, domestic service, and working for a parent/guardian who is 100% owner of the business.
- 14-15 Years: Must file an Employment and Age Certificate with the Department of Labor and Human Rights. Maximum 3 hours on school days, 8 hours on non-school days, 18 hours in school weeks, and 40 hours in non-school weeks. Work is prohibited between 7:00 PM and 7:00 AM (extended to 9:00 PM from June 1 through Labor Day). Prohibited occupations include cooking/baking, construction, door-to-door sales, operating power-driven machinery, and work involving explosives or chemicals.
- 16-17 Years: No state restrictions on maximum working hours or nightwork. However, they are strictly prohibited from working in federally defined hazardous occupations, including roofing, most driving, and most work involving power-driven machines.
- Employers must comply with both North Dakota and federal child labor regulations, always following the stricter standard.
- Licensing Requirements: Many professions – including contractors, electricians, plumbers, cosmetologists, real estate agents, and others – require a valid license issued by the appropriate North Dakota licensing board or commission. Anyone posting professional services must verify they hold the appropriate license. All businesses operating in North Dakota must register with the Secretary of State's office.
- Notice Requirements: Employers must display required labor law postings in the workplace, including the "ND Minimum Wage & Work Conditions Summary Poster," workers' compensation information, unemployment insurance information, and anti-discrimination protections. Required posters are available at no cost from the North Dakota Department of Labor and Human Rights.
