🔍 North Carolina Labor & Employment Laws – What You Need to Know

North Carolina law sets clear standards for employers, workers, and service providers. All hiring and service posts must comply with the following:

  • Minimum Wage: North Carolina's minimum wage is $7.25 per hour, which matches the federal minimum wage. Employers must pay the higher of state or federal rates.
  • Tipped Employees: Employers may pay tipped employees $2.13 per hour as a direct cash wage, provided tips bring total compensation to at least $7.25 per hour.
  • Overtime Pay: The North Carolina Wage and Hour Act requires overtime pay for most non-exempt employees at one and one-half times the regular rate after 40 hours in a workweek. The FLSA provides the exclusive remedy for overtime claims when applicable. Agricultural employees are exempt from overtime requirements.
  • Worker Classification (Employee Fair Classification Act): Misclassification of employees as independent contractors carries significant penalties, including workers' compensation liability, unpaid payroll taxes, and potential criminal charges. The North Carolina Industrial Commission investigates misclassification claims. Employers are required to prominently display a poster outlining the difference between an employee and an independent contractor.
  • E-Verify Requirement: North Carolina law requires any employer with 25 or more employees in the state to use the federal E-Verify system to verify the work authorization of all new hires. This threshold does not include seasonal or temporary employees working fewer than nine months in a calendar year.
  • Retaliatory Employment Discrimination Act (REDA): REDA protects employees from retaliation when exercising rights under workers' compensation, wage and hour, OSHA, and mine safety laws. North Carolina is an at-will employment state, with exceptions for contracts, anti-discrimination law violations, and public policy violations.
  • Child Labor Laws:North Carolina has strict child labor regulations under N.C.G.S. § 95-25.5:
    • Under 14: Generally prohibited from employment, with limited exceptions for newspaper delivery, acting, and domestic work.
    • 14-15 Years: Requires a Youth Employment Certificate. Maximum 3 hours on school days, 8 hours on non-school days, 18 hours in school weeks, and 40 hours in non-school weeks. Work is prohibited between 7:00 PM and 7:00 AM (extended to 9:00 PM from June 1 through Labor Day).
    • 16-17 Years: No state restrictions on maximum working hours or nightwork. However, they are strictly prohibited from working in federally and state-defined hazardous occupations, including manufacturing, mining, logging, and operating power-driven machinery.
