New Jersey Labor & Employment Laws – What You Need to Know
New Jersey law sets clear standards for employers, workers, and service providers. All hiring and service posts must comply with the following:- Minimum Wage: Effective January 1, 2026, New Jersey's minimum wage is $15.92 per hour for most employees. The minimum wage is adjusted annually based on increases in the Consumer Price Index (CPI).
- Seasonal and Small Employers: Employers with fewer than 6 employees are now required to pay $15.23 per hour, up from $14.53.
- Agricultural Workers: Agricultural workers must be paid $14.20 per hour.
- Long-Term Care Staff: Direct care staff in long-term care facilities must be paid $18.92 per hour.
- Tipped Employees: Tipped workers have a minimum cash wage of $6.05 per hour, with a maximum tip credit of $9.87 per hour. The employer must ensure that tips plus the cash wage equal at least the full state minimum wage of $15.92 per hour. If the employee's total compensation falls short, the employer must make up the difference.
- Pay Transparency Law: Effective June 1, 2025, employers with 10 or more employees total must include the hourly or salary compensation (or a range) and a general description of benefits and other compensation programs in all job postings.
- Overtime Pay: New Jersey follows federal Fair Labor Standards Act (FLSA) requirements for overtime pay, requiring premium pay (one and one-half times the regular rate) after 40 hours in a workweek for most non-exempt employees. Certain employees may be exempt based on their duties and salary level.
- Worker Classification – ABC Test:Effective October 1, 2026, New Jersey finalized new regulations clarifying the application of the "ABC" test for worker classification. To be classified as an independent contractor, the employer must prove all three prongs:
- A: The worker is free from control or direction over the performance of services.
- B: The services are performed either outside the usual course of the employer's business or outside all of the employer's places of business.
- C: The worker is customarily engaged in an independently established trade, occupation, profession, or business.
- Failure to satisfy any single prong results in classification as an employee. The regulations apply to the New Jersey Wage and Hour Law, Wage Payment Law, Unemployment Compensation Law, Earned Sick Leave Law, and Temporary Disability Benefits Law.
- Workplace Rights: New Jersey law prohibits discrimination and retaliation in the workplace. Workers have the right to file complaints with the New Jersey Department of Labor and Workforce Development or the Equal Employment Opportunity Commission (EEOC). New Jersey also has strong protections for employees under the New Jersey Law Against Discrimination (NJLAD). Additionally, under the Worker Freedom from Employer Intimidation Act (NJWFEIA), employers are generally prohibited from compelling employees to attend "captive audience" meetings intended to convey the employer's views on religious or political subjects, including labor organization activity.
- Child Labor Laws: New Jersey has strict child labor regulations that work in tandem with federal rules. Minors under 14 are generally prohibited from employment. Minors aged 14-15 have strict hour limitations and must obtain work permits. Minors aged 16-17 have fewer restrictions but are prohibited from hazardous occupations. Employers must comply with both New Jersey and federal child labor regulations, always following the stricter standard.
- Licensing Requirements: Many professions – including contractors, electricians, plumbers, cosmetologists, real estate agents, and others – require a valid license issued by the appropriate New Jersey licensing board or commission. Anyone posting professional services must verify they hold the appropriate license. All businesses operating in New Jersey must register through the Business.NJ.gov portal.
- Notice Requirements: Employers must display required labor law postings in the workplace, including the minimum wage poster, earned sick leave information, workers' compensation information, unemployment insurance information, and anti-discrimination protections. Required posters are available at no cost from the New Jersey Department of Labor and Workforce Development.
