New Hampshire Labor & Employment Laws – What You Need to Know
New Hampshire law sets clear standards for employers, workers, and service providers. All hiring and service posts must comply with the following:- Minimum Wage: New Hampshire's minimum wage is $7.25 per hour, the same as the federal minimum wage. The state has no mechanism to raise it above the federal rate, and it has remained at this level since 2009. Employers covered by the Fair Labor Standards Act (FLSA) must pay at least this amount.
- Tipped Employees: New Hampshire allows a tip credit. Tipped employees must receive a cash wage of at least $3.26 per hour (45% of the minimum wage), provided that tips bring total compensation to at least $7.25 per hour. A tipped employee is generally defined as one who receives more than $30 in tips per month in the normal course of duties.
- Overtime Pay: New Hampshire follows federal Fair Labor Standards Act (FLSA) requirements for overtime pay, requiring premium pay (one and one-half times the regular rate) after 40 hours in a workweek for most non-exempt employees. Certain employees may be exempt based on their duties and salary level.
- Reporting Pay: New Hampshire law requires that when an employee reports to work at an employer's request, they must be paid at least 2 hours' pay at their regular rate. This requirement does not apply to employees of counties or municipalities, or to ski and snowboard instructional employees at ski resorts who receive other compensation equivalent to their rate of pay. A good-faith effort by an employer to notify an employee not to report to work may also exempt them from liability.
- Workplace Rights: New Hampshire law prohibits discrimination and retaliation in the workplace. Workers have the right to file complaints with the New Hampshire Department of Labor or the Equal Employment Opportunity Commission (EEOC). The Department of Labor also regulates workplace safety for public employers under RSA 277 and LAB 1400.
- Child Labor Laws:New Hampshire has strict child labor regulations that work in tandem with federal rules:
- Under 12: Generally prohibited from employment, with limited exceptions.
- 12-15 Years: Requires a Youth Employment Certificate ("Working Papers") obtained through the employer's request and the minor's school or superintendent's office. Maximum 8 hours per day (48 hours per week) during non-school weeks; 3 hours per day (23 hours per week) during school weeks. Work prohibited between 9:00 PM and 7:00 AM.
- 16-17 Years: Requires written parental permission on file at the workplace at the time employment begins. Graduates are exempt from this requirement. Work limited to 48 hours per week, 6 days per week. If not enrolled in school, 10 hours per day (48 hours per week) in manufacturing; 10¼ hours per day (54 hours per week) in other employment. No state restrictions on nightwork for this age group.
- Employers must comply with both New Hampshire and federal child labor regulations, always following the stricter standard. Minors under 16 are prohibited from hazardous occupations as defined in state and federal law.
- Licensing Requirements: Many professions – including contractors, electricians, plumbers, cosmetologists, real estate agents, and others – require a valid license issued by the appropriate New Hampshire licensing board or commission. Anyone posting professional services must verify they hold the appropriate license. All businesses operating in New Hampshire must register with the Secretary of State's office. - Notice Requirements: Employers must display required labor law postings in the workplace, including the minimum wage poster, unemployment insurance information, workers' compensation information, and anti-discrimination protections. Required posters are available at no cost from the New Hampshire Department of Labor.
