Nevada Labor & Employment Laws – What You Need to Know
Nevada law sets clear standards for employers, workers, and service providers. All hiring and service posts must comply with the following:- Minimum Wage: Effective January 1, 2026, Nevada's minimum wage is a unified $12.00 per hour for all employees statewide. The previous two-tier system based on health insurance offerings has been eliminated.
- Tipped Employees: Nevada law does not permit a tip credit against the minimum wage. Tipped employees must receive the full minimum wage of $12.00 per hour in base pay, regardless of how much they earn in tips. It is illegal for an employer to count tips toward the minimum wage requirement.
- Overtime Pay (The Dual Threshold):Nevada has unique daily and weekly overtime requirements based on the employee's wage rate:
- Under $18.00/hour: Employees earning less than $18.00 per hour (1.5x the minimum wage) must receive overtime pay (1.5x their regular rate) for any hours worked over 8 hours in a 24-hour period, AND for any hours worked over 40 hours in a workweek.
- $18.00/hour or more: Employees earning $18.00 per hour or more are exempt from the daily 8-hour rule, but must still receive overtime pay for hours worked over 40 in a workweek, consistent with the FLSA.
- Paid Leave Requirements: Under NRS 608.0197, Nevada employers with 50 or more employees must provide paid leave to eligible employees. Employers with fewer than 50 employees must provide unpaid leave. Employees accrue 0.01923 hours of paid leave for each hour worked, up to a maximum of 40 hours per benefit year.
- Apprentice Utilization Act (AUA): Contractors and subcontractors working on public works projects in Nevada must report apprentice hours annually through the AUA reporting portal. The portal is open from January 1 to February 15 each year. Failure to submit a report constitutes a violation subject to penalties and/or disqualification from public works projects.
- Employee Misclassification – ABC Test:Nevada uses the "ABC" test to determine worker classification for unemployment insurance purposes. A worker is presumed to be an employee unless all three conditions are met:
- A: The person is free from control or direction over the performance of services.
- B: The service is either outside the usual course of the business or performed outside all of the business's places of business.
- C: The person is engaged in an independently established trade, occupation, profession, or business of the same nature.
- Misclassification penalties include civil penalties of $5,000 or 10% of underreported amounts, plus interest and potential criminal charges.
- Workplace Rights: Nevada law prohibits discrimination and retaliation in the workplace. Workers have the right to file complaints with the Nevada Office of the Labor Commissioner, the Nevada Equal Rights Commission, or the Equal Employment Opportunity Commission (EEOC).
- Child Labor Laws: Nevada has strict child labor regulations that work in tandem with federal rules. Minors under 14 are generally prohibited from employment with limited exceptions. Minors aged 14-15 have strict hour limitations and must obtain work permits. Minors aged 16-17 have fewer restrictions but are prohibited from hazardous occupations. Employers must comply with both Nevada and federal child labor regulations, always following the stricter standard.
- Unemployment Insurance Taxable Wage Base: Effective January 1, 2026, the taxable wage base for unemployment insurance contributions is $43,700. UI taxes are paid on an individual's wages up to this amount during the calendar year.
- Licensing Requirements: Many professions – including contractors, electricians, plumbers, cosmetologists, real estate agents, and others – require a valid license issued by the appropriate Nevada licensing board or commission. Anyone posting professional services must verify they hold the appropriate license. All businesses operating in Nevada must register through the SilverFlume Nevada Business Portal.
- Notice Requirements: Employers must display required labor law postings in the workplace, including the minimum wage poster, daily overtime annual bulletin, paid leave information, workers' compensation information, and anti-discrimination protections. Required posters are available at no cost from the Nevada Office of the Labor Commissioner.
