Nebraska Labor & Employment Laws – What You Need to Know
Nebraska law sets clear standards for employers, workers, and service providers. All hiring and service posts must comply with the following:- Minimum Wage: Effective January 1, 2026, Nebraska's minimum wage is $15.00 per hour for all employees, as approved by a 2022 voter initiative. The minimum wage was scheduled to adjust annually based on the Midwest Consumer Price Index, but Legislative Bill 258 (LB258), effective July 17, 2026, changes this to a fixed 1.75% annual increase beginning January 1, 2027.
- Youth Minimum Wage: LB258 establishes a youth minimum wage of $13.50 per hour for employees ages 14 and 15 (who are not emancipated minors), effective July 17, 2026. Beginning January 1, 2030, the youth minimum wage will increase by 1.5% every five years.
- Training Wage: LB258 raises the training wage for new employees ages 16-19 (not including seasonal/migrant workers or emancipated minors) to $13.50 per hour through December 31, 2026. Beginning January 1, 2027, the training wage will increase by 1.5% annually. The training wage is limited to the first 90 days of employment.
- Tipped Employees: Nebraska allows a tip credit. Employers may pay tipped employees a cash wage of $2.13 per hour, provided that the employee's tips bring total compensation to at least the applicable minimum wage (currently $15.00 per hour).
- Overtime Pay: Nebraska follows federal Fair Labor Standards Act (FLSA) requirements for overtime pay, requiring premium pay (one and one-half times the regular rate) after 40 hours in a workweek for most non-exempt employees. Certain employees may be exempt based on their duties and salary level.
- Nebraska WARN Act (Mini-WARN): Legislative Bill 921, effective July 17, 2026, adopts the Nebraska Worker Adjustment and Retraining Notification Act. Employers with 100 or more full-time employees must provide 90 days' advance notice (longer than the federal 60-day requirement) of a business closing or mass layoff affecting 100 or more full-time employees at a single site. Unlike federal WARN, Nebraska WARN has no percentage threshold requirement. Enforcement is exclusively by the Nebraska Department of Labor, with a civil penalty of up to $100 per day of violation. Employees have no private right of action under the state law.
- Workplace Rights: Nebraska law prohibits discrimination and retaliation in the workplace. Workers have the right to file complaints with the Nebraska Department of Labor or the Equal Employment Opportunity Commission (EEOC). Under LB921, businesses that experience a closure or mass layoff lasting longer than six months affecting 100 or more full-time employees must provide 90 days' advance notice to employees and the Department of Labor.
- Child Labor Laws:Nebraska has strict child labor regulations that work in tandem with federal rules. The stricter standard always applies:
- Under 16: Must have an employment certificate on file. No more than 8 hours per day or 48 hours per week. Work restricted to 6:00 AM – 10:00 PM (can be extended to 10:00 PM with a special permit if no school the next day; 8:00 PM for children under 14). Minors under 16 are prohibited from working in occupations dangerous to life, limb, health, or morals, as defined in state law.
- 16-17 Years: Nebraska state law does not specifically regulate hours for this age group. However, federal law prohibits employment in federally defined hazardous occupations. Employers must comply with both Nebraska and federal child labor regulations, always following the stricter standard.
- Licensing Requirements: Many professions – including contractors, electricians, plumbers, cosmetologists, real estate agents, and others – require a valid license issued by the appropriate Nebraska licensing board or commission. Anyone posting professional services must verify they hold the appropriate license. All businesses operating in Nebraska must register with the Secretary of State's Business Services Division.
- Notice Requirements: Employers must display required labor law postings in the workplace, including the updated minimum wage poster reflecting the 2026 rate, workers' compensation information, unemployment insurance information, and anti-discrimination protections. Required posters are available at no cost from the Nebraska Department of Labor.
