🔍 Missouri Labor & Employment Laws – What You Need to Know

Missouri law sets clear standards for employers, workers, and service providers. All hiring and service posts must comply with the following:

  • Minimum Wage: Effective January 1, 2026, Missouri's minimum wage is $15.00 per hour under Proposition A, approved by voters. The rate applies to most covered employees statewide, making Missouri's minimum wage one of the higher state minimums in the nation for 2026.
  • Employers Subject to Minimum Wage: Employers engaged in retail or service businesses whose annual gross income is less than $500,000 are not required to pay the state minimum wage rate. Employers not subject to the minimum wage law can pay employees wages of their choosing.
  • Federal Law Supremacy: Employers are generally subject to both state minimum wage laws and the federal Fair Labor Standards Act (FLSA). Certain provisions of Missouri state law may be less restrictive than federal law, and employers covered by the FLSA that only follow a less restrictive provision of Missouri state law will be in violation of federal law.
  • Tipped Employees: Employers are required to pay tipped employees at least 50 percent of the minimum wage, $7.50 per hour, plus any amount necessary to bring the employee's total compensation to a minimum of $15.00 per hour.
  • Sub-Minimum Wage for Minors (Pending Legislation – SB 1325): Missouri Senate Bill 1325 would allow employers to pay a sub-minimum wage of $12.30 per hour to employees under 18 years old. The bill has advanced out of committee but had not become law as of mid-2026. Employers should monitor this legislation closely as it would create an age-based wage distinction if enacted.
  • Overtime Pay: Missouri follows federal Fair Labor Standards Act (FLSA) requirements for overtime pay, requiring premium pay (one and one-half times the regular rate) after 40 hours in a workweek for most non-exempt employees. The Division of Labor Standards enforces compliance with the state minimum wage law.
  • Paid Sick Leave: Although earlier ballot measures had required paid sick leave, Missouri's legislature repealed that portion of the law in 2025; therefore, paid sick leave is no longer mandated for most employers as of 2026.
  • Workplace Rights: The Missouri Commission on Human Rights enforces Missouri's anti-discrimination statute, which prohibits discrimination in housing, employment, and places of public accommodation. Workers have the right to file complaints with the Commission on Human Rights or the Equal Employment Opportunity Commission (EEOC).
  • Child Labor Laws:Missouri has strict child labor regulations for workers under 18:
    • Under 14: Generally prohibited from employment, with limited exceptions.
    • 14-15 Years: Prohibited from working in connection with power driven machinery (except lawn and garden machinery in domestic service), oiling/cleaning machinery, ladders/scaffolding, mines/quarries, stone cutting/polishing (except jewelry), explosives manufacturing/storage/transport, motor vehicle operation, blast furnaces/rolling mills/foundries/forging shops, sawmills/woodworking machinery, freight elevators/hoisting machines/cranes/manlifts, occupations involving radiation or radioactive substances, toxic/hazardous chemicals, motels/hotels/resorts (except physically separated offices), establishments selling alcoholic beverages (unless at least 50% of gross sales are non-alcoholic), and other occupations dangerous to the life, limb, health, or morals of children under 16.
    • 16-17 Years: No state restrictions on maximum working hours or nightwork. However, they are strictly prohibited from working in federally defined hazardous occupations.
    • Employers must comply with both Missouri and federal child labor regulations, always following the stricter standard.
  • Licensing Requirements: Many professions – including contractors, electricians, plumbers, cosmetologists, real estate agents, and others – require a valid license issued by the appropriate Missouri licensing board or commission. The Division of Professional Registration has a list of professions that require licenses. Anyone posting professional services must verify they hold the appropriate license. All businesses operating in Missouri must register with the Secretary of State's office. Missouri does not require a statewide general business license, but many LLCs need federal, state, or local licenses or permits depending on their business activities, industry, and location.
  • Notice Requirements: Employers must display required labor law postings in the workplace, including the updated minimum wage poster reflecting the 2026 rate, unemployment insurance information, and anti-discrimination protections. Required posters are available at no cost from the Missouri Department of Labor and Industrial Relations.
