Maryland Labor & Employment Laws – What You Need to Know
Maryland law sets clear standards for employers, workers, and service providers. All hiring and service posts must comply with the following:- State Minimum Wage: Under the Fair Wage Act, all employers (regardless of size) must pay a minimum wage of $15.00 per hour. Employees under 18 years of age must earn at least 85% of the State Minimum Wage Rate (currently $12.75 per hour). Tipped employees (earning more than $30 per month in tips) must receive a cash wage of at least $3.63 per hour, provided tips bring total earnings to at least $15.00 per hour.
- County-Level Minimum Wages (2026):Several Maryland counties have higher minimum wage rates. Employers operating in these jurisdictions must verify and comply with local rates:
- Montgomery County (Effective July 1, 2026): Large employers (51+ employees) – $18.00/hr; Mid-size (11-50 employees) – $16.50/hr; Small (10 or fewer) – $15.95/hr.
- Howard County (Effective July 1, 2026): All employers – $16.00/hr.
- Prince George's County (Effective January 1, 2026): $15.30/hr.
- Living Wage for State Service Contracts: Effective September 29, 2026, contractors on State service contracts valued at $100,000 or more must pay covered employees at least the higher of the State or local minimum wage, or the Living Wage rate established for the applicable Tier area. Tier 1 areas (Anne Arundel, Baltimore City/County, Howard, Montgomery, Prince George's) require $17.54/hr (except Montgomery County where large employers must pay the County minimum of $18.00/hr). Tier 2 areas require $15.00/hr.
- Overtime Pay: Maryland requires premium pay (one and one-half times the regular rate) after 40 hours in a workweek for most non-exempt employees. Certain employees may be exempt based on their duties and salary level. Employers should consult the Maryland Department of Labor for specific exemption criteria.
- Paid Family and Medical Leave (FAMLI): The Time to Care Act (TTCA) establishes a paid family and medical leave insurance program. Effective January 1, 2027, employers and employees will begin payroll contributions. Benefits will become available no later than January 3, 2028. Eligible employees may receive up to 12 weeks of paid leave (up to 24 weeks for certain conditions) with wage replacement up to 90% (capped at $1,000/week). Employers with 15+ employees must contribute; employees contribute regardless of employer size.
- Workplace Rights: Maryland law prohibits discrimination and retaliation in the workplace based on race, color, religion, sex, age, national origin, disability, genetic information, marital status, sexual orientation, gender identity, or veteran status. Workers have the right to file complaints with the Maryland Department of Labor or the Equal Employment Opportunity Commission (EEOC).
- Child Labor Laws: Minors under 14 are generally prohibited from employment except in limited circumstances. Minors under 16 must obtain a work permit and are subject to hour restrictions, including limitations on hours per day and per week, and restrictions on work before 7:00 AM and after 7:00 PM (9:00 PM from June 1 to Labor Day). Prohibited occupations include those involving hazardous machinery, excavation, demolition, and other dangerous work. Employers must comply with both Maryland and federal child labor regulations, always following the stricter standard.
- Licensing Requirements: Many professions – including contractors, electricians, plumbers, cosmetologists, real estate agents, and others – require a valid license issued by the appropriate Maryland licensing board or commission. Anyone posting professional services must verify they hold the appropriate license. All businesses operating in Maryland must register with the Secretary of State's office.
- Notice Requirements: Employers must display required labor law postings in the workplace, including information about workers' compensation, anti-discrimination protections, wage rights, and child labor restrictions.
