🔍 Louisiana Labor & Employment Laws – What You Need to Know

Louisiana law sets clear standards for employers, workers, and service providers. All hiring and service posts must comply with the following:

  • Minimum Wage: Louisiana has no state minimum wage law; the federal minimum wage of $7.25 per hour applies universally. Tipped employees may be paid a cash wage of $2.13 per hour, provided tips bring total compensation to at least $7.25 per hour. The employer must cover any shortfall. No local jurisdictions have enacted a higher minimum wage rate for non-governmental employees.
  • Unemployment Benefits – Stricter Work Search Rules (Act No. 151): Effective December 31, 2025, Louisiana tightened unemployment eligibility. Claimants are now required to complete five weekly work-search activities (increased from three), such as applying for jobs, attending interviews, or updating résumés. Employers are empowered to report no-shows or interview ghosts directly to the Louisiana Workforce Commission, effectively deputizing HR departments as the state's auditors.
  • Second Chance Hiring Incentives (SB 227): Effective January 1, 2026, for certain formerly incarcerated individuals hired within one year of release, their work will not be treated as "employment" for unemployment-related tax and administrative purposes for up to five years. This lowers the cost of labor for businesses willing to hire this workforce.
  • Workplace Violence Prevention – "Behind the Counter Protection Act" (HB 1238 / Act No. 342): Effective August 1, 2026, this new law provides stronger protections for customer-facing employees in retail and food-service establishments against workplace violence. It expands employee protections and enhances criminal penalties for assault, battery, robbery, intimidation, verbal abuse, and threats against covered employees. Simple battery conviction now carries a potential $2,000 fine and/or up to two years imprisonment.
  • Overtime Pay: Louisiana does not have state-specific overtime laws beyond federal requirements. The federal Fair Labor Standards Act (FLSA) requires premium pay after 40 hours in a workweek for non-exempt employees. Louisiana employers must comply with the federal overtime requirements.
  • Workplace Rights: Louisiana law prohibits discrimination and retaliation in the workplace. Workers have the right to file complaints with the Louisiana Commission on Human Rights or the Equal Employment Opportunity Commission (EEOC).
  • Child Labor Laws: Under Louisiana law (RS 23:161 and LAC 40:VII.101), minors under 14 are generally prohibited from employment. Minors 14-15 years of age may work in permitted occupations outside of school hours with hour restrictions. At 16 years of age, youths may be employed in any non-hazardous occupation. Certain occupations are specifically prohibited for minors, including work in mines, quarries, manufacturing explosives, sawmills, logging, and operating power-driven machinery. Employers must comply with both Louisiana and federal child labor regulations, always following the stricter standard.
  • Licensing Requirements: Many professions – including contractors, electricians, plumbers, cosmetologists, real estate agents, and others – require a valid license issued by the appropriate Louisiana licensing board or commission.
