Kentucky Labor & Employment Laws – What You Need to Know
Kentucky law sets clear standards for employers, workers, and service providers. All hiring and service posts must comply with the following:- Minimum Wage: Kentucky's minimum wage is $7.25 per hour, directly tied to the federal rate. A state law dictates that if the federal minimum wage increases, Kentucky's automatically follows. Several bills have been introduced in the General Assembly to increase the state minimum wage to $15.00 per hour by 2029, but none have been enacted as of 2026. Local municipalities cannot establish higher minimum wages, as the Kentucky Supreme Court struck down such local ordinances. Tipped employees may be paid a cash wage of $2.13 per hour, provided tips bring total earnings to at least $7.25 per hour.
- Overtime Pay: Kentucky law requires employers to pay time-and-a-half for any hours worked over 40 in a single workweek, mirroring the federal FLSA requirements. Certain employees, such as retail, restaurant, and hotel workers, are exempt from this requirement under state law.
- Workplace Rights: Kentucky law prohibits discrimination and retaliation in the workplace. Workers have the right to file complaints with the Kentucky Education and Labor Cabinet or the Equal Employment Opportunity Commission (EEOC). Kentucky law protects against discrimination based on race, national origin, color, religion, sex (including pregnancy, gender identity, and sexual orientation), parental status, age (40 and over), disability, genetic information, smoker/non-smoker status, military status, and political affiliation.
- Child Labor Laws: Kentucky restricts the employment of minors under 18 in hazardous occupations and limits hours for minors under 16. Minors aged 14-15 may work outside school hours, no more than 3 hours on school days, 18 hours per school week, and between 7:00 AM and 7:00 PM (9:00 PM from June 1 to Labor Day). Minors aged 16-17 may work up to 30 hours per school week (with parental permission up to 32.5 hours, and with school certification and parental permission up to 40 hours), with restrictions on hours before school days. Employers must comply with both Kentucky (KRS Chapter 339) and federal child labor regulations, always following the stricter standard.
- Licensing Requirements: Many professions require a valid license issued by the appropriate Kentucky licensing board or commission. Anyone posting professional services must verify they hold the appropriate license. All businesses must register with the Kentucky Secretary of State through the online portal.
- Notice Requirements: Employers must display required labor law postings, including information on wage discrimination, workers' compensation, and unemployment benefits. Required posters can be obtained from the Education and Labor Cabinet.
