Indiana Labor & Employment Laws – What You Need to Know
Indiana law sets clear standards for employers, workers, and service providers. All hiring and service posts must comply with the following:- Minimum Wage: Indiana's minimum wage is $7.25 per hour, which is the same as the federal minimum wage. Employers covered by the Fair Labor Standards Act (FLSA) must pay at least $7.25 per hour. Tipped employees may be paid a minimum cash wage of $2.13 per hour, with tips making up the difference to reach $7.25 per hour.
- Youth Employment Rules: Effective January 1, 2025, Indiana's youth employment laws underwent significant changes (House Enrolled Act 1302). The state permanently decommissioned the Youth Employment System (YES) portal; employers are no longer required to report, register, or track minor employees through the state. Additionally, teenagers aged 16 and 17 may work the same hours and days as adults without parental permission. However, employers must still strictly comply with federal and state hour and hazardous duty restrictions for 14- and 15-year-olds.
- Overtime Pay: Indiana does not have state-specific overtime laws; however, the federal Fair Labor Standards Act (FLSA) requires premium pay after 40 hours in a workweek for non-exempt employees. Indiana employers must comply with the federal overtime requirements.
- Workplace Rights: Indiana law prohibits discrimination and retaliation in the workplace. Workers have the right to file complaints with the Indiana Department of Labor or the Equal Employment Opportunity Commission (EEOC).
- Licensing Requirements: Many professions – including contractors, electricians, plumbers, cosmetologists, real estate agents, and others – require a valid license issued by the appropriate Indiana licensing board or commission through the Indiana Professional Licensing Agency (IPLA). Additionally, all businesses operating in Indiana must register through the INBiz portal and may need local permits from their city or county.
- Notice Requirements: Employers must display required labor law postings in the workplace, including information about workers' compensation, anti-discrimination protections, and wage rights.
