🔍 Hawaii Labor & Employment Laws – What You Need to Know

Hawaii law sets clear standards for employers, workers, and service providers. All hiring and service posts must comply with the following:

  • Minimum Wage: Effective January 1, 2026, Hawaii's minimum wage is $16.00 per hour. This is part of a phased increase schedule, with a final rate of $18.00 per hour effective January 1, 2028.
  • Tip Credit: Beginning January 1, 2026, Hawaii law permits employers to take a tip credit of up to $1.50 per hour for tipped employees (under Act 114). This means tipped employees must receive a direct cash wage of at least $14.50 per hour ($16.00 minimum wage minus $1.50 tip credit), provided their total hourly earnings from wages and tips equal at least $7.00 more than the applicable minimum wage (i.e., at least $23.00 per hour total).
  • Overtime Pay: Hawaii requires premium pay after 40 hours in a workweek for non-exempt employees, consistent with Chapter 387 of the Hawaii Revised Statutes.
  • Workplace Rights: Hawaii law prohibits discrimination and retaliation in the workplace. Workers have the right to file complaints with the Hawaii Department of Labor and Industrial Relations or the Hawaii Civil Rights Commission. Effective January 1, 2026, employers must also provide paid rest periods of at least 10 minutes for every 4 hours worked.
  • Licensing Requirements: Many professions – including contractors, electricians, plumbers, cosmetologists, real estate agents, and others – require a valid license issued by the appropriate Hawaii licensing board or commission. The Professional and Vocational Licensing (PVL) Division oversees 25 boards and 27 licensing programs. Anyone posting professional services must verify they hold the appropriate license.
  • Notice Requirements: Employers must display required labor law postings in the workplace, including information about workers' compensation, anti-discrimination protections, wage rights, and paid rest period requirements.
