🔍 California Labor & Employment Laws – What You Need to Know

California law sets clear standards for employers, workers, and service providers. All hiring and service posts must comply with the following:

  • Minimum Wage: California's standard minimum wage is $16.90 per hour effective January 1, 2026, for all employers regardless of size. The minimum wage is adjusted annually based on the Consumer Price Index (CPI). California does NOT allow a tip credit – tipped employees must be paid the full minimum wage directly by the employer.
  • Overtime Pay:California has some of the strictest overtime laws in the nation. Non-exempt employees are entitled to:
    • 1.5x the regular rate for hours worked over 8 hours in a workday or over 40 hours in a workweek
    • 2x the regular rate for hours worked over 12 hours in a workday (daily double time)
    • 2x the regular rate for hours worked over 8 hours on the 7th consecutive day in a workweek
  • Exempt Salary Threshold (2026): To be classified as exempt from overtime, employees must earn a salary of at least $70,304 per year ($1,352 per week) for 2026, based on 2x the state minimum wage for full-time employment (40 hours/week).
  • Worker Classification (AB5 & ABC Test): California strictly enforces worker classification standards under the ABC Test established by Assembly Bill 5 (AB5) and codified in Labor Code § 2750.3. A worker is presumed to be an employeeunless the hiring entity can prove ALL THREE of the following:
    • (A) The worker is free from control and direction in connection with the performance of the service, both under the contract and in fact;
    • (B) The worker performs work that is outside the usual course of the hiring entity's business; and
    • (C) The worker is customarily engaged in an independently established trade, occupation, or business of the same nature as that involved in the work performed.
    Certain professions (e.g., licensed attorneys, architects, engineers, real estate agents) may be exempt from the ABC Test under the "Borello" test. Misclassification carries severe penalties, including unpaid wages, liquidated damages, and civil penalties of up to $25,000 per violation (Labor Code § 226.8).
  • Meal & Rest Breaks:California employers must provide:
    • Paid 10-minute rest break for every 4 hours worked (or major fraction thereof)
    • Unpaid 30-minute meal break for every 5 hours worked (must be taken before the 5th hour)
    Failure to provide breaks results in one additional hour of pay at the employee's regular rate per missed break (Labor Code § 226.7 and § 512).
  • Licensing Requirements: California requires licensing for many professions through the Department of Consumer Affairs and the Contractors State License Board (CSLB). Under Business and Professions Code § 7000 et seq., any contractor performing work valued at $500 or more (including labor and materials) must hold a valid CSLB license and include their license number in all advertisements, contracts, and bids. The CSLB issues licenses for 46 contractor classifications (general building, electrical, plumbing, HVAC, painting, roofing, etc.). Unlicensed contracting carries civil penalties of up to $5,000 for a first offense and up to $10,000 for subsequent violations. Anyone posting professional services must verify they hold the appropriate state licenses and will provide proof upon request.
  • Workplace Rights: California law prohibits discrimination, retaliation, and unfair labor practices. Workers have the right to file complaints with the California Civil Rights Department (CRD), the California Department of Industrial Relations, the California Labor Commissioner's Office, or the Equal Employment Opportunity Commission (EEOC).
  • Notice Requirements: Employers must display required labor law postings in the workplace, including information about workers' compensation, minimum wage, paid sick leave, family leave, and anti-discrimination protections. California law also requires employers to provide employees with a written notice (DLSE Form N-001) at the time of hire detailing their pay rate, payday, and other employment information.
  • Privacy Rights (CCPA/CPRA): Under the California Consumer Privacy Act (CCPA) and the California Privacy Rights Act (CPRA), California residents have specific privacy rights, including the right to know what personal information is collected, the right to delete personal information, the right to opt-out of the sale or sharing of personal information, the right to correct inaccurate information, and the right to limit the use and disclosure of sensitive personal information.
