🔍 Montana Labor & Employment Laws – What You Need to Know

Montana law sets clear standards for employers, workers, and service providers. All hiring and service posts must comply with the following:

  • Minimum Wage: Effective January 1, 2026, Montana's minimum wage is $10.85 per hour for all employees. The minimum wage is adjusted annually on January 1 based on the Consumer Price Index (CPI). Montana does NOT allow a tip credit – tipped employees must be paid the full minimum wage directly by the employer, regardless of how much they earn in tips.
  • Overtime Pay: Montana follows the federal Fair Labor Standards Act (FLSA) standard, requiring 1.5x the regular rate after 40 hours in a workweek for non-exempt employees. The federal salary exemption threshold for executive, administrative, and professional employees is currently $1,128 per week ($58,656 per year). Agricultural and seasonal workers may have different overtime requirements.
  • Worker Classification & ICEC Requirements: Montana strictly regulates independent contractors. A worker must be free from control or direction and be engaged in an independently established trade. Critically, any solo operator or independent contractor in the construction or trades sector must hold a valid Independent Contractor Exemption Certificate (ICEC) issued by the DLI, or hold self-elected workers' compensation insurance. Hiring someone without a valid ICEC or misclassifying an employee to avoid taxes and insurance carries fines up to $5,000 per violation.
  • Wrongful Discharge (Montana's "Good Cause" Standard): Montana is unique in that it is not a traditional "at-will" employment state for most employees. Under the Montana Wrongful Discharge From Employment Act (WDEA) (MCA §§ 39-2-901 to 39-2-915), after an employee successfully completes a probationary period (typically 6 to 12 months), an employer must have "good cause" to terminate employment. A discharge is wrongful if it is (1) in retaliation for the employee's refusal to violate public policy, (2) not for good cause after the probationary period, or (3) violates the employer's own written personnel policies.
  • Contractor Registration & Licensing:Montana relies heavily on a registration system for construction work to ensure workers' compensation compliance:
    • General Contractors: Any business with employees performing construction work must hold a Construction Contractor Registration (CCR) from the Montana DLI. This requires proof of workers' compensation insurance.
    • Solo Contractors: Must hold an Independent Contractor Exemption Certificate (ICEC).
    • Specialty Trades: Competency-based licensing is required for specialty trades. Plumbers must hold a state plumbing license, and electricians must hold a Montana State Electrical Board license.
    • Anyone posting professional construction services must verify they hold the appropriate CCR, ICEC, or trade license and will provide proof upon request.
  • Workplace Rights: Montana law prohibits discrimination, retaliation, and unfair labor practices. Workers have the right to file complaints with the Montana Department of Labor and Industry, the Montana Human Rights Bureau, or the Equal Employment Opportunity Commission (EEOC).
